Car hire regulations.

As far as the hire agreement does not specify otherwise, the hirer is obliged to comply to the hereby regulations.


1. The driver.

The hired car may be driven solely by the person(s) listed in the hire agreement. The condition to sign the hire agreement is that the hirer is 21 or older and presents a valid driving licence. Cars may be hired by citizens of European Union, Switzerland, Danmark, Norwegian, Australia and New Zeland, Canada and the United States of America. The hired car cannot be hired further without a written owner’s permission.


2. Documents needed to hire a car.

A driving licence valid for the Repubic of Poland and:

  EU citizens – an identity card

  other persons – an identity card or passport and a credit card


3. Booking fee.

A fee to confirm hirer’s willingness to hire a car. The fee is equal to the hiring fee for a 24-hour period.


4. Hiring fee.

A fee paid in advance for the period declared in the hire agreement. If the reservation has been done, the booking fee is subtracted from the hiring fee.


5. Deposit.

The security deposit value is between 500 PLN and 1500 PLN. It is paid when the car is made available to the hirer. The deposit is returned to the hirer when he returns the car to the owner. The deposit is kept by the owner in case of violation of hereby regulation. In case the deposit does not cover owner’s claims, the owner reserves the right to impose additional fee covering losses caused by violation of the regulation.


6. Pick-Up/Return place.

The place of car reception and/or return is stated in the hire agreement. The hirer is obliged to return the hired car with a full gasoline tank, all hired equipment and car keys in the agreed place and time.


7. Period of hire.

The time, in which the hirer uses the car, is specified in the hire agreement. The hire period is 24 hours or multiplication of that period. If returning of the car is delayed under 1 hour a 30 PLN fee is imposed on the hirer. If returning of the car is delayed more than 1 hour, a fee for the next 24 hours is imposed on the hirer, which is not synonymous to prolonging the hire period.


8. Changing the hire period.

When the hire agreement is in force, prolonging the hire period may be executed exclusively by written permission of the owner, not later than 24 hours before the period in the hire agreement expires. If the car is returned to the owner before the hire period expires, this fact does not entitle the hirer to demand a return of the fee. If the hirer wilfully prolongs the hire period, a 200% penalty will be imposed on the hirer. If the hire period is wilfully prolonged by more than 48 hours, the extra fee is 500 PLN plus tax, the owner will also inform the Police, that the car has been stolen.


9. Booking.

The hirer should book a car not later than 48 hours before the beginning of the hiring period. In order to book a car:

Within 6 hours after receiving the filled form, the nice car representative will contact you in order to confirm the reservation.


10. Cancelling the reservation.

The reservation may be cancelled not later than 48 hours before the hiring period begins.. In such case the owner charges the hirer with 10% of the reservation fee. If the reservation is cancelled within last 48 hours before the hiring period begins, the owner keeps 100% of the reservation fee.


11. Limitations.

When leaving the Republic of Poland, the hirer is obliged to communicate this to the owner. It is not allowed to leave the area of the European Union (excluding Switzerland and Norwegian). Moreover, it is forbidden to enter the following countries: Lithuania, Latvia, Estonia, Byelorussia, Ukraine, Russia, Moldova, Romania, Slovenia, Croatia, Yugoslavia, Bosnia and Herzegovina, Albania, Bulgaria, Greece, Turkey. Cyprus.


    It is forbidden to:


Leave the car open (doors, windows, boot, etc.)
Leave car documents or keys in the car (registration card, hire agreement)
Drive the car when drunk, after taking drugs or other forbidden substances
Transport forbidden number of passengers and/or animals and/or load
Use a defective car
Tow other vehicles
Smoke in the car
Drive on not hardened roads
Take part in shows or rallies


12. During the hire period the hirer is obliged to:

possess his driving licence, registration card, the proof of obligatory insurance (OC) and the hire agreement
obey traffic regulations
secure the car from stealth, especially by locking the car while parking and activating anti-theft installations
check engine oil level, cooling liquid level, car lights


Any shortages in the aforementioned media should be replenished by the hirer on his own cost.


13. Insurance.

The car is insured. The hirer is obliged to become acquainted with and to obey all insurance conditions. If the car is stolen together with its registration card and/or keys, the hirer takes full financial liability for the lost car. The hirer is liable for any damages due to his abuse, which are not covered by the insurance. Damages included in the insurance policy are paid according to the own share stated in the insurance conditions up to 500 PLN. Damages worth less than 500 PLN are covered solely by the hirer.


14. Losing keys or documents is a violation of the hereby regulations. The deposit will not be returned, and the hirer will be charged with a full cost of reconstructing lost items.


15. In the case of a car accident or collision, the hirer is obliged to inform immediately:

Emergency (if there are wounded or killed).
Owner’s representative.
Police.


Furthermore, the hirer is obliged to safe the area of accident in order to prevent the car from further damage.
The hirer is not in force to set up any agreements with other participants of the accidents.
Violating this condition will be treated as a gross violation of the hereby regulations and will result in retaining the deposit by the owner and charging the hirer with all costs to return the car to a fully operational state.


16. If the car has been stolen, the hirer is obliged to inform immediately police and owner's representatives. Violating this condition will be treated as a gross violation of the hereby regulations and will result in retaining the deposit by the owner and charging the hirer with all costs to return the car to a fully operational state.
If the radio has been stolen together with its front panel, the hirer will be charged with repair costs and the cost of purchase a new radio.


17. In case of a car break-down, the hirer is obliged to immediately inform the representative of the owner about that fact. The owner will appoint the nearest authorised service. The hirer is charged with the costs of repairs in the service appointed by the owner. The costs will be accounted for when returning the car, on the basis of the service invoice for the owner. If the car is immobilised in Poland for more than 12 hours, the owner is obliged to replace the defective car with another of similar type, or, if impossible, return the part of the fee. The hire period is automatically prolonged by the time of servicing or using the substitution car.


18. The hirer is not obliged to observe terms of periodical technical inspections. Taking into consideration mileage specified in the hire agreement (+/- 500 km), the hirer will deliver the car to the owner in the specified place and time. If the hirer makes impossible for the owner cannot to have one of the aforementioned inspections done, the owner will charge the hirer with full costs of the inspection and possible additional costs (eg. Loss of warranty).


19. The car is made available with full fuel containers and windscreen washing liquid, provided, that the contracto or other mutual agreement (prepared in writing and signed by both parties) does not state otherwise. In case the car being returned is not fully fueled and/or the windscreen washer container is not full, the tenant must refund the cost of missing fuel and/or windscreen washing liquid. The price list for missing fuel and/or windscreen washing liquid is available at the employee of NICECAR. The prices are not negotiable.


20. The court competent to settle any disputes arising out of the hiring agreement shall be the court having the jurisdiction over the registered office of the owner. Any matters not regulated in this regulations shall be governed by the provisions of the Polish law.


21. The English version of the information herein is to facilitate understanding the claims of the regulations and may by no means be the ground to decide any legal dispute. The Polish version of regulations and the Polish law are solely in force.


22. Nice Car Company reserves the right to refuse the car rental (prolong the rental agreement) with no further explanations.
